Overview

The EB-1A category is designed for individuals who have risen to the very top of their field. USCIS defines extraordinary ability as sustained national or international acclaim, evidenced by either a major one-time achievement (such as a Nobel Prize, Oscar, or Olympic medal) or by satisfying at least 3 of 10 regulatory criteria.

Unlike most employment-based green cards, EB-1A does not require an employer sponsor or a PERM Labor Certification. You may self-petition using Form I-140, making it one of the most flexible pathways for highly accomplished professionals.

Premium processing (Form I-907) is available for I-140, allowing USCIS to adjudicate the petition within 15 business days.
