Overview

The EB-2B category is for individuals who possess exceptional ability in the sciences, arts, or business — defined as a degree of expertise significantly above that ordinarily encountered in those fields. Unlike EB-1, it does not require sustained national or international acclaim.

EB-2B typically requires employer sponsorship and a PERM Labor Certification, unless the applicant also files a National Interest Waiver. To qualify, you must meet at least 3 of 6 USCIS criteria.

Key Requirements

• Exceptional ability in sciences, arts, or business — meeting at least 3 of 6 USCIS criteria:
• Official academic record (degree, diploma, or certificate) in the field
• At least 10 years of full-time experience in the occupation
• License to practice the profession
• High salary or remuneration evidencing exceptional ability
• Membership in professional associations
• Recognition for achievements by peers, government, or professional/business organizations
• Employer sponsorship and PERM Labor Certification required (unless NIW)
